A traditional feature of this adoption process has been the so-called "most favored nation" requirement. Today, a network of interdependent legal provisions, found in the statutes or contracts of numerous states and localities, obligate textbook publishers -- in essence -- to treat most favored nation jurisdictions equally, at any one time, with regard to the price of a textbook. Unfortunately, the precise meaning of this deceptively simple obligation of equal treatment has at times become a source of serious confusion and uncertainty. Obviously, confusion over one of the fundamental features of textbook marketing can create serious dislocations to the detriment of both publishers and purchasing agencies.
